Three years ago I successfully reclaimed bank charges from Halifax to the amount of £900 give or take a few pounds. They asked me to sign a statement to accept these charges and it also said I could never ever claim against them.
I am currently struggling financially as I went over my overdraft a few months ago and got whacked with four bank charges amounting to £170. Since then I have been unable to stay the right side of my agreed limit due to the charges coming out followed by essential direct debits. I have worked out that in the past 5 months I have been charged over £400.
I spoke to Halifax and they said that because I signed the statement I could never claim back these charges. Is there any way round this as I want to be financially stable but am unable to free myself from the charges.
I'd be grateful of peoples' responses.
Many thanks
Andrew

RRegardless of the wording, you cannot be forced to sign away your rights, whatever Halifax call centre drones tell you. They asked me to sign a statement to accept these charges and it also said I could never ever claim against them.
So yes, you can claim any new charges since the refund.0 -
Can't be sure without seeing your letter but am guessing that when you settled with Halifax before, you agree to take so many pounds as reimbursment on your charges. One of the terms of agreeing to this and accepting the refund would prevent you from claiming back any other charges before that time.
The right to any further legal claims in the future can't be signed away
As I said, only guessing0 -
Thanks for replying.
Has anyone else had to sign a form with Halifax and then managed to claim back charges after?? Really need this cash back to sort myself out - beginning to become a huge problem!
Thankyou0
