I believe I have mis-sold car Finance

OK, firstly bear with me this is a bit of a long story, but i need to explain it in full so fellow MSE will get the full picture..


My Story begins in 2003, my Car was Stolen and the outstanding finance was settled from the Insurance money. Now having no money left over , my partner purchased a car, there were all sorts of bits and bats added to the policy Gap insurance , warranties etc etc.. any how i diagress, the salesmen asked me to provide my detials at the top of the form, as I was the registered driver of the car ( at the time partner did not hold a full UK license), I gave across my name address and Driving License number and that was all, no other detials were submitted. Now skip forward a couple of yrs until Mid 2007, due to ill health and unemployment, making payments on the car had stopped, so naturally the debt has defaulted to an agency, the debt had increased from £6990 pounds to almost £15k, we took advise from the CAB ( brilliant ), and they came up with a solution of reducing the payments down to £129 a month for 12 month then £256 for the duration, which to date we have kept up with, no problem there..


Last week I ordered my credit file from Credit expert on there 30 day trial thing, and i was surprised to see that the name of the Finance company was on my file as a debt, when the car was taken out in my partners name, and i was never put down as a gurantee, none of the letters re missed payments have ever come to me, yet this is on my credit file, and this is the reason why I am unable to score a high rating.... ( rating of 455 out of 999 ). What can I do? I am no longer in touch with the finance company who have gone bump, the agency who have the debt being paid, refer me to the company who the intial loan was taken out with, to be honest I'm lost as where to turn next

Perhaps MSE's on this site may throw me a bone......, do i have any recourse for action?

    Sounds like you need to write to experian and equifax explaining the issue and asking for the default to be removed.

    If you have the original paperwork that will really help. Otherwise you might need a solicitor to take a statement under oath from you declaring that you were never a signatory to the loan.

    The agency should also have a copy of the loan agreement, or access to it, otherwise they cannot legally enforce your current repayments.

  • Maybe the CRA have linked the 2 of you. Do you have a joint account for example elsewhere?
