redundancy

I was told i was going to be made redundant in november .i have heard nothing more about it since then.Then today i get a phonecall from my employer to say,i will be getting paid by another firm from tomorrow.surely this cant be legal.I have had nothing in writing about anything.but have just found out that my nat insurance as not been paid since last april.Any advice will be welcome.

Very naughty of your employer.

Re the National Insurance - that seriously DOES need to be paid up-to-date - to make sure you stay qualified for benefits, etc - so I'd chase that one up definitely if I were you (if need be get the relevant Government Department to do it for you).

Re being told with such SHORT notice that you are now working for someone else - huh! Ask your Union about this - I would have thought one was supposed to have been given proper notice in writing of this sort of thing.

thanks ceridwen for the reply.unfortunatly i am not in a union. do you think i will be made to pay nat ins if he doesn t pay it for some reason.also i am not sure about the tax being paid.if he as not paid that can i be made to pay it.

I don't think it will be down to you to pay the possibly unpaid NI or income tax. Your pay will be deemed to have been paid to you nett of those deductions and the employer is responsible for paying them over to HMRC.

thanks little voice for your reply.do u think i should hold out for redundancy approx £2500.or just finish and take the other job.i dont want to sound greedy.but i have worked my nuts off for the last eight years and feel i should be worth something.

It doesn't sound like redundancy to me - more like a transfer of undertaking. In that case it would be that you are being employed on the same basis as before (salary, hours, pension or whatever) and with continuity of employment. You should get new T&C from the new employer which confirm this.
