CSA & Child Benefit

Hi thank you for taking the time to give advice
My partner is paying through the CSA, his eldest left education and he was told by his ex that the child had gone into further education, which subsequently turned out to be untrue.
He has phoned the csa and they have confirmed that the ex does not received child benefit anymore BUT until this is CONFIRMED by the ex they will not stop the DEO..... the ex will certainly NOT answer the calls or letters from the CSA because of course shes still getting money from the csa, what i need to know is IF the csa KNOW she is not in receipt of child benefit then why do they need confirmation from the un co-operative ex!!!! the mind boggles....:confused:

    if pwc is not in receipt of child benefit then payments should be stopped. any payments made after C.B. stopped should be given back to you.

    they want to know from PWC and not authoritys because PWC word is gospel :rolleyes:
  • Thanks for the reply Jack, CSA told him that the the PWC hasnt been in receipt of CB since September...... but havent stopped the DEO they are still insisting that they get confirmation from the PWC, surely if shes not getting CB why do they still need it confirmed by the PWC... gawd im blabbering sorry, just doesnt make sense in my book.....
    PS they wont let him make an application until the confirmation from the PWC has been received, BUT i know shes not going to reply to them... so what happens then????? does the DEO carry on forever or what????????

    no legal advice is freely and readily available against the csa

    what kind of organisation can one not fight against in a free country ? an illegal one

    Bellabeauty - do you have a good enough relationship with the child to ask them to confirm in writing that they have are no longer in further education?

    It is an offence to mislead the CSA and your partners ex could be liable for a fine of up to £1000 - could she be reminded of this?

    It might also be worth reminding her that repayments to you will be backdated to the time when the child ended education.

  • when you apply to the csa they send a letter out to the nrp and give 7 days for them to respond surely this should apply both ways? you could always contact your mp as this would sort things out alot sooner

    Sou, yeah the child will be willing BUT it would cause trouble for her as the mother tends to throw her out when she sides with dad GRRRRRRRR... she hasnt mislead the CSA she just never told them, as she wasnt asked she didnt say anything, why would she when the money comes rolling in!!!! the CSA have said that ONCE she answers them (i doubt very much) then they will re-assess him on payment of the younger child and reduce that payment....dont worry im like a dog with a bone, i wont let it go.....
