Moneyclaim website service

Options
Hi all,

Currently 2 months into a dispute with a jewelers who supplied a substandard ring and refused to refund, filed the claim with Moneyclaim through Northampton court and got a default judgement as the company never bothered to respond.

What's my next step here? The website is a bit vague. I know I can now issue a warrant of execution (for additional cost) but what does that mean for me? More costs down the line? Can they just point blank still refuse to pay? Feels like I'm throwing good money after bad here.

Thanks!
Monty

I'm assuming that you have actually been issued the default judgment?

Yes, next step is to enforce. How much is the claim for?

Warrant of execution is not the most effective means of enforcement in every case.

Yes, judgement was issued on the 28th Jan. Claim is for £365.

For that amount probably warrant of execution is the best approach. Its worth a go. Not much point having a judgment without trying to enforce.

OK, so I paid my £55 and issued the warrant only to see online that it now shows as 'unfulfilled' ... any idea what that means?

Also have a letter this morning from the local court entitled 'Notice of transfer of proceedings' saying that they're going to deal with the defendant's application to set judgement aside. I thought that judgement was done and dusted when judgement was issued in my favour back in Jan??

Any ideas people ... does this mean I'm going to court for them to hear my case?

    Thanks,
    Monty
