My situation is as below:
  • The loan was agreed on 21st Jan 2004 - so not that old.
  • I am paying it off still - will be for another 2-3 years.
  • I don't have copies of the loan agreement paperwork.
  • I don't recall the conversation about the loan terms and any PPI but am certain I would not have agreed to PPI had I been told.
What should I do next in order to try to reclaim my PPI?

PS I have asked this before but got conflicting advice....

    What company is this hun?

    If you've not paperwork for this contact them and ask if they can supply any to you, you may have to pay a £1 for a copy of the agreement, check with them first to see what they can supply to you, this should take about 12 days for it to reach you from request, you can write to them and ask them and always post by recorded delivery for your proof of posting and to keep a check on the timescales they have, you can check this out on the royal mail website - track and trace section.

    If it comes to it, you do have the option of requesting a SAR (subject access request), but there is a charge of £10 cheque or postal order payment for this, they have 40 days to comply and supply you with everything they have on you.

    If you check the threads, you will come across a SAR thread, there you will find the template, just delete what does not occur to you.

    As soon as you have something, even the agreement, as this should only take 12 days, you can prepare to get a letter to reclaim and complain if you believe you were mis sold in any way.

    Thank youi so much for replying. I've had some real success reclaiming credit card charges but this PPI reclaiming just seems so confusing....:confused:

    I've written to them now asking for a copy of my original agreement, using the template letter on here. Will that be enough then do you think, rather than asking for a SAR?

    Hopefully it will be here soon.

    Not a problem your most welcome.

    Yes the agreement should be just fine, an SAR is the last option really but can be useful if its a battle on the reclaim, for more evidence if required, but yes this should be okay, please keep us posted and fingers crossed.;)

    I have not actually dealt with charges myself lol and would find that again a different issue with reclaiming PPI lol.....:D .
