I've just been in a similar position. Made redundant in September, left nov 30th, started with new firm on Dec 1st in same line of business (insurance).
I had restrictive covenants on my employment contract. Essentially, they cannot restrict your right to take on new employment. They may however act if you then approach your old clients in your new role.
I work in a technical role so this was never really an issue for me. I also left my old employer on good terms, despite the redundancy.
It may be relevant if you work in a sales role and plan to approach your old clients.0 -

My role is a sales one and there is a (major) shared client, which is why I sought legal advice initially. As I mentioned, their opinion (due to the specifics of my situation, which I'll not get into here) was that they would be unlikely to succeed if they prosecuted me, though that may not stop them from trying.
The nature of the job means that I can't wait 3 months either, so I'm left in a bit of a bind. I intend to discuss the situation with my propective employer (if my old company gets an injunction out against me, they'll get an injunction out against them too), I'd prefer to be covered 'privately' too however.
Thanks again for the help, I'm hoping I'll get my head around this one way or another.
