I agree - everything should be in writing only.
If you are still unemployed, i would suggest setting up a token payment of £1 unless you are absolutely certain you can offer more and that any other creditors are getting an equal percentage of available monies.
Also, have you reclaimed any charges that were aplied to this account? After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

hi george, thanks again. yes i reclaimed about ~£120 charges previously and put it towards my debt on this card. so do you think i should go with the make token payments then request CCA plan?0
-
If the debt is currently enforcable, then it is better to make payments towards it (unless it is almost statute barred). If they did take you to court, the fact that you have been making payments would count in your favour.
If £1 is all you can afford then this is all you should pay. Until the company fail to supply you with a copy of the CCA then the debt is enforcable - if they fail to supply one then the debt is unenforcable. If they see you can only afford a very small amount as payment per month, they may decide to accept your offer rather than wait 30 years or so for the debt to be paid off. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

hi just been reading this thread i have had similar problems with CD UK and egg. When they restructured they cancelled my card and after i could not pay the balance of £6500 and not paying regularly i have received a default on my credit file. I am now getting badgered by Collect direct for payment i agreed to £120 per month for 3 months which i paid now they are on my back again. I am self employed and cannot really afford to pay this sum as with credit crunch work is a lot quieter than normal. any suggestionspjays666 :rotfl:

is it a co-incidence that i posted the cca request to collect direct uk on 12th march and they wrote back on 18 march to say they closed their file on me on 10th march and passed it back to egg? do i resend the cca request to egg now?0
-
I would only send it to egg if they are actively pursuing you for payment.
As the CCA request doesn't actually give you a copy of the original document (no signature required), it would be fairly easy for them to make a reproduction and try to pass this off as details taken fro mthe original rather than from their systems. A SAR may give you a copy of the original, but hopefully you can put that off for quite a while. After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
