HSBC Account in dispute

Hi guys,

I hope you can help me...I've got an old HSBC bank account with about £350 in charges etc. I put the wheels in motion to reclaim in July 07 shortly before the beginning of the test case, I was promptly replied to by HSBC stating that they'd put my claim on hold pending the test case completion blah blah... but last year they started pestering me to pay it back...I sent a few letters stating that as the account is in dispute and I will repay the amount (or not) pending the result of the test case which they didn't seem to understand and as a result recently passed it to a debt collection agency to collect the full amount.

As a goodwill gesture; I paid £100 which was the amount of my original overdraft, leaving the remainder amount made up of charges...now the debt collection agency want the rest....Do I have to pay this as the account is still in dispute pending the test case?? I'm hoping to find some legal ground to arm myself and essentially tell them to go take a hike until the test case completes.

Can anyone help please?

    No, the account is in dispute and they can't collect or place a Default notice on your file.

    Send them a stern letter reminding them of your rights and say you will be complaining to the OFT.

    Thanks Dippychick, I thought that was the case - could you point me in the direction of what my rights are and I can start getting a letter together
