right time to cca or not?

I am on a self managed dmp, today I have had a letter from lovely mbna saying the following.
A DEFAULT is due to register on your credit file in the next few days in relation to the above account.
This will seriously affect your ability to gain any form of credit in the future (who cares)
When the default is registered, the balance of your account will be sold on to a third party.
1.This means you will no longer be a customer of MBNA ( OH NO...)
2. THE RESPONSIBILITY FOR RECOVERY OF THE OUTSTANDING BALANCE WILL BE SOLEY THAT OF THE 3RD PARTY
3.The default registered against you will be transfered into the name of the 3rd party.
4.The 3rd party will take actions they deem appropriate to recover the outstanding balance.
TO PREVENT THIS FROM HAPPENING YOPU MUST MAKE AN IMMEDIATE PAYMENT OF £--- BY DEBIT CARD TODAY.
Please call tel
to clear your outstanding arears and discuss your repayments.
Now do I wait untill they sell the debt on and cca them or do it now to MBNA
I have tried my best to pay them what I can afford, the payments are regular, on time etcI am not in arrears with my reduced payments, but still they want more.I am not up to phoning these creeps at the moment,.So when is the best time to send my CCA request.

    MBNA have a poor record for having CCAs, so go for it now.

  • i took this card out in about 2004/2005 ,I would have willingly paid the monthly payments I have been for the last 18mths but they obviously dont think its enough, If I waited till it got sold on to a 3rd party do you think it would stall it a bit longer and be more difficult for them?

    Chances of the legally acceptable CCa being around are limited.

    What advantege do you thing you gain from waiting?

  • I think you should request the CCA

    At the moment, I and several other people, are being taken through the court process by MBNA and their solicitors, Restons.

    That default notice is only their part of the process - they are being extremely aggresive with going to court currently.
    Unsecured debt 2008 c £45,000
    Current unsecured debt February 2016 £1,734.85
  • Yes I have been issued court papers too from Restons which I am defending, I am awaiting my CCA, Restons when asked for them since ALL correspondence was to go through them rtnd my request saying the firm is not the creditor so cannot act on behalf of the Bank! Think they just wanted to stall my request as BANG next day they issued me court papers. Have since sent my CCA letter back to them with a PO again & one to MBNA too duplicating all the information/£1 again. I heard its not too late for a CCA request as long as you have not got your CCJ yet and it should all help in my defence.

    Most likely, though they'd argue til the cows come home they didn't. If you see what I mean. ;)

  • Well I for one saw right through why they returned it back to me (though acting on behalf of them they should have advised MBNA of my request!) This just gets me more fired up now ready, however suspect the CCA from the year 2000 wont surface to me in time. One will wait & see. Its a shame it has resorted to this as all of my other cards have been quite accepting of my reduced payments from Payplan hence not feeling the need to request CCA's on those? :confused:

    Prior to 2006 most of MBNA's CCAs are actually PRORITY APPLICATIONS.

    Chances are they havnt got it, but will come up with some bull of why the y dont need it.

    No Longer works for MBNA as of August 2010 - redundancy money will be nice though.

  • MBNA are the only creditor not charging me interest at the moment - so I'm happy to leave them be, but if / when they start charging me, I will definitely send a CCA request (account was opened in 1999)

    I'm not sure that they've noticed they are not charging me interest - all the horror stories of MBNA on here, but when I set up my DMP 4 years ago, they immediately accepted and I have heard nothing from them since.
