Any Comments from Martin Lewis Re: getting loans written off?

  • I think this is on topic.

    I want to write to my lender and get the copy of the original pre 2007 credit agreement.
    When writing to the lender, if as in my case the lender is using solicitors to chase the money, should I write to the solicitors acting on behalf of the lender or to the lender, to seek a copy of the original credit agreement.

    Or, if solicitors are involved does it mean the case has gone to far?

    I would write to the lender and send a copy of the letter to the solicitor.
    I am a former Broker, former IFA and former compliance officer, for my sins.

    However, I have since seen the light.

    As I don't know the original address of the lender as they are a large plc and have several addresses: customer services, Card services, Retail Bank Collections, Registered Office, etc, do you have any suggestions as to the most appropriate address to send my letter to?

    Hi guys,

    I expect this question is old hat to most of you but despite trawling through these ore-2007 threads I can't find anyone saying they have used one of these companies with success or failure. I have a guy phoning me on monday to whom I intend paying 2x £295 up front to look into whether 2 loans can be reduced. I am assured it takes less than 12 weeks to confirm whether it is possible, likely less, and if not I get a full refund. The up front payment makes sense to me as if they got back to you with good news, you'd simply say thanks and do the rest yourself without paying them a fee, once you knew you had a case. Yes it sounds to good to be true but also no harm trying if I get my cash back?

    I don't accept that there are no anecdotes of experience with these companies because of those succeeding being "gagged", since the forum's are completely anonymous anyway!

    So has anyone heard of anything anywhere, on these forums or elsewhere to suggest that I'd be stupid to pay over the money? Please, only fact-based answers rather than "you should pay your debts you bad person you" or "sounds like a scam to me".

    So let me get this correct in my head.

    You were a trainee laywer, yet you are willing to pay nearly £600 to a company you know nothing about in terms of results, in order to check your loan agreements against publicly available legislation that should be understandable to any lawyer - even trainee ones.

    Considering you have posted on a moneysaving site, what you are proposing sounds a bit like moneywasting to me.

    I have had a catalogue account deemed non-enforceable. I know this is not "written off" and it's not a loan, however, they could not produce the CCA and therefore have sent written confirmation that they will not be enforcing the agreement nor passing it on. Achieved by initially using templates from this site & not by using / paying a company.
