Car hit by uninsured driver - help needed.

Late last year our car was hit by a driver who was clearly to blame.

As time has dragged on we have become more and more concerned about whats going on.

Today our insurance company have informed us that the other was actually uninsured. :mad:
He took out a policy half an hour after the incident and his insurance company have therefore washed their hands of the matter.

We now face the prospect of having to pay the excess out of our own pockets, amounting to £350. This is not a massive amount but its £350 that to be quite honest, we simply can't afford.

Does anyone have any advice they can offer on this matter, it seems so unfair that we will have to pay £350 for something no fault of our own?

    The MIB won't assist as you have had the damage repaired under your own insurance policy.

    But even if the third party was insured, you would still have had to pay your excess, then attempted to get it reimbursed from the third party (either yourself, via your solicitor or using any legal protection insurance).

    Providing there is no argument about liability you can (and should) still do this.

    Going from memory, the MIB has a £300 excess on claims so it wont help recover the excess other than £50.

    Why on earth did you pay for a policy which had a £350 excess?
