Help Debt collector

Hi there Money. Lets start with the easy bits.
The account is a basic Barclays Cash account. Or a Co-Op Cashminder. Both are BR friendly and you can phone them to open an account. Fast and easy - numbers are on the relevant websites.
Are you both planning on BR? You would need to if you are both named on the mortgage/debts as they would just chase the other person.
As so mortgage and so. In the first missed payment, it tends to be a letter that month. More letters after that and perhaps the odd phone call. It can take a few months before they get heavy with it, so you could save some serious money. You could stay there for as long as it takes until they reposses which can be anything from 3 months to a year. Having children you would be in a better position for council housing, but depending on the availability in your area, it could be a hostel style place for some months. Speak to your local Shelter group about it. They can help here and give you the correct details. If you wanted to rent privately then its best to do it before BR. You should get help with the rent because of your income, but its finding a landlord that would take you on that may be the difficult bit. However, shelter and the council could help here.
If you are going to stop paying the mortgage, then you have to stop paying everything (all debts that is!). Get your new account open as soon as you can to get your benefits transfered into that so you can walk away from your old account.
Its a lot to do, but its a start.
And a big well done on being brave.0 -
Money,
These people have no rights whatsoever. By law, they can only call with an appointment, and as you have no wish to make an appointment, it ends there! They are trespassing on your property, so tell them to get lost and threaten to call the police. They CANNOT take your property as they are not baliffs. Threats like this are nothing but scare tactics, be strong and tell them where to get off.0 -
Here's a template letter (taken from one of Fermi's posts) that you can amend to your circumstance and send off to capital one?
Obviously this one is geared up to be sent before you get a home visit so will need to be changed a little
Dear xxxx
Account Ref xxxx
Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me by telephone over the past few weeks/months and these have been duly logged by time and date.
Furthermore, should it be your intention to arrange a “doorstep call”, please be advised that under OFT rules, you can only visit me at my home if you make an appointment and I have no wish to make an appointment with you.
There is only an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v. Sheppard and Short Ltd [1959] 2 Q.B. per Lord Evershed M.R.).
Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and if you do so, then you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.
Yours faithfully,:hello:Save a little money each month and at the end of the year you’ll be surprised at how little you have.An eye for an eye only ends up making the whole world blind0
