Cancelling dispute before obtaining refund?

I bought one of those touch screen 16GB Mp4 Player from a Chinese Ebayer, the ones that look like an iPhone. Anyway I did not receive it, so I opened a PayPal dispute and asked for my money back.

The seller have now sent a an ebay message as set below:

sorry to you,can you cancel the dispute on ebay at first and i will full refund to you,is ok??
because if you don't cancel it ,the money will be locked,and i can't refund to you,wish you can forgive!


I have had been previously given other refunds off PayPal before cancelling a dispute, so what gives with this one?

I don't think I should cancel the dispute before getting my refund.

Any advice on this would be welcome!!!

    he can refund you during the dispute! he is trying to get you to cancel to get away with refunding you, because you can't re-open the dispute or open another one!

    Exactly !! - do not cancel the dispute and i would be tempted to raise the dispute to a paypal decided resolution using that message as the reason - they will probably refund you immediatley.

  • Go into your resolution centre....it should be an option there... Sorry to be vague, it's been a couple of months since I had my last one of these....

    The dispute will be closed WHEN the person refunds you. He's talking complete poo.

    The money is held by paypal, so neither party can access it until the dispute is resolved...eg when the money is refunded to the buyer. (Some such confusion).

    ETA: Escalate to Claim:
    You can escalate the dispute to a PayPal claim within 20 days of opening the dispute. We automatically close disputes after 20 days.
    Wait until you are 100% satisfied with the resolution before closing a dispute. A closed dispute cannot be reopened or escalated to a PayPal claim.
    Select the open dispute in the Resolution Centre and click the desired action at the bottom of the dispute details screen to close or escalate a dispute.
    We require more information from you when you escalate a dispute to a PayPal claim.

    just email them back saying you are not a total muppet and you know how refunds and claims/disputes work...show me the money!!

  • Just to give an update.

    Buyer has now refunded my money, but I think only because PayPal would probably have decided in my favour in tommorrow's deadline. He now wants me to cancel the transaction so he can get his fees back, but I am so furious about the way he tried to defraud me out of my refund that I am not going to cancel.
