This was what you told me last week - have I done it wrong?
I very much doubt I would have informed you to request your CCA, once legal action has commenced a CCA request has no effect.

The defense you'll be using in your case is the defective default notice and unlawfully termination of your a/c.

  • I think I've got it wrong and should have filed an acknowedgement and I've done a defence.

Should have been more thorough - its my error.

I only did it tonight, can I speak to the court and rescind the defence and change it first thing in the morning?

It's best to try and keep to one thread if you can so it's easier to follow, not to worry, as long as you've acknowledged the court claim, you now need to work on your defence, the CCA will form part of that defence, I was under the impression from your posting above, you were using the CCA request as a sole defense.

  • I guess thats what I've put in my defence form - can I alter my defence prior to the hearing, or can I turn up with a different defence?

What is the date your acknowledgement needs to be in by?

You have 14 days AFTER acknowledgement to file your defence.

  • I had the original form on the 28th of January, so had 14 days from then (which I calculated as Tuesday next week.

    I submitted a defence tonight.

  • My point being that I filed a defence not an acknowledgement - is this incorrect?

If you have until this Tuesday to acknowledge the claim, then you're OK, but do it asap.
    I submitted a defence tonight.
That's OK, did you use the CCA request as you're defence?

Thats not an option now as I've already completed the defence, its taken-off the list of available options

Yes, realise thats wrong now, can I change it if I call the court in the morning?
