Tenant deposits

Can I retrospectively register a tenant's deposit with the DPS? Could doing so incur a penalty?

When you say "retrospecively" I assume you mean you should have registered it and you haven't within the legal requirement of 14 days.
If so, yes you can register it late. There is no penalty as such albeit the tenant could try and bring a court action for 3xdeposit which is the "penalty" for failure to protect however, due to poorly drafted legislation and court decisions since the deposit laws were brought in it is highly unlilkely the tenant would be successful.
Don't forget you also need to send the prescribed information to the tenant that is also available to download off the DPS website.0
