Help needed re:layed off/sacked/redundant

I need some advice about my partners previous employment. He was off sick from work and his employer rang and said he was laying him off. He then said he was infact terminating his contract. A week later he got a letter saying he had been made redundant
.
He has only received 1 weeks pay from the previous week he worked before he was layed off/sacked/made redundant.
He hasn't received any notice at all or any other payments.
Is there anything he can do or is his employer allowed to do this, he worked for them for almost 2 years
thank you in advance.

Speak to ACAS tomorrow, if he is in a union - he should speak to them too.
Is there a reason why your OH was off work? If he was on long term sick then they can make him redundant if the job no longer exists.0 -
He was off due to a chest infection, it was his first day off and he got the call from his employer as soon as he left the doctors who signed him off for a week. His employers partner works at the doctors :rolleyes:Virgin CC=£2652, Next= [STRIKE]£102.88,[/STRIKE] Very=£475.60, Natwest=£800, Sainsburys CC=£1777.02, Lloyds CC=£498.29, Lloyds Loan= £13,946.18, Car=£4000Total = [STRIKE]£26,147.23[/STRIKE] £23,849.09:eek:0

As Horace says, speak to Acas or a union if applicable, but generally speaking, employers can make you redundant whilst off sick, but there is still a procedure to go through, not just writing a letter. An employer would be required to invite your OH to a meeting to discuss it, so he could explain his reasonings etc and give your OH chance to answer any queries etc. From there, a written reason of the outcome is required to be sent to your OH, explaining that he would have the chance to appeal if he so wished.
As he has worked for them for almost 2 years, and not over, he would be entitled to one weeks notice, unless his contract said differently0 -
Less than 2 years service = no redundancy payment.
As he has not worked the statutory 2 full years he is not entitled to any redundany payment.
He would only be entitled to his notice period money. But as BITC points out they have gone about it all wrong and i also would suggest you speak to ACASmake the most of it, we are only here for the weekend.
and we will never, ever return.0 -
