payback time - oil dispute

I wondered if anyone knows about if an item is ticked as been left in a property eg curtains and then when we move in and they are not there what can be done about it

the thing is we have had a vendor from hell and we are due to complete asap and after looking at the paperwork this weekend i have noticed that she has marked down that she is leaving the curtains in the bedroom and living room

now from what i can recall there were never any curtains any of the rooms as the all have those lovely office style blinds in

will we be able to get revenge and claim for the cost of new curtains from her

(i am not usually one for revenge but trust me this is one time that even an angel would want to screw this woman for every penny she has got)

secondly the only thing that is holding up exchanging contracts is because the vendor filled up the oil tank and now wants us to pay for it (tank was illed 2 months ago) our solicitor is arguing that we were going to pay for gas taking to the property and so we wouldn't of filled the tank anyway but she has prodiced an invoice and wants us o pay

if we pull out now then obviously we will lose a lot of money but i won't lose the sale over a couple of hundred quid

any advice about how to appraoch this would be gratefully received

now you can see why i want revenge, the solicitor has already called the vendors solicitor and told her to take out what she put in

thanks in advance everyone and sorry for the HUGE moan

Well we finally did it got a house not on a main road, next a railway line or any other werid and wonderful things that get on my nerves!!!

    on the first point I guess you get to keep the blinds; if there are no curtains to remove she won't remove them.

    The oil thing is a bit more tricky. If she had paid the council tax for the year upfront you would be expected to pay from the date you completed. The same with gas and electric, I can see why she would want the oil paid. It may not be possible for her to arrange for the oil to be collected due to contamination issues. In practical terms won't you want to use the oil until you get gas installed?

    my partners friend works for british gas and so can fit everthing for "mates rates" we have already saved enough money for this to be done

    i don't think i explained myself clearly after we had offered on the property the vendor filled up the tank, however when we had looked at it previously it was half full which is why we can't understand why she has filled it up

    Er, the blinds should be left. Most fixtures and fitting forms just say curtains (though I guess you could cross out and write blinds in). Why would you expect curtains, when you know there are blinds already there? Based upon your logic, they could always take the nice blinds down and put up some smelly old ones (assuming they kept them).

    the vendor has ticked that there are blinds and curtains which is what i couldn't understand as it had both options on the form she completed

    As long as the vendor has said the blinds are to be left then the wiil be , otherwise contract breeched ( you could theSue if you wished) as far as the oil goes.. I would just drop the matter as you say for the sake of £200 , I know its difficult, but think of how much you stand to loose if you start to haggle over such a relitively small amount

    My suggestion would be to meet half way with the cost of the oil i.e £100, stating that you didnt request it in the first place, but say it ever so nicely... :D
