xbox 360 faulty, can I get a new replacement fron online store, help?

Hi I bought my son an xbox 360 for xmas and now it won't read disks.
What I'd like to ask is, am I entitled to get a new replacement? I bought the console online from gamestation. I have rang MS and they say return it to them, but i have read they can send you back a refurb! I did not pay £200 for a used console! I have been recommended to read through the sale of goods act (thank you little john) but I don't really understand it
does anyone know from the sale of goods act what I quote when i ring gamestation and try to get it exchanged?
