Tenants in Common - Dispute

I am currenlty in dispute with my flat mate, we both own 50% of the property as tenants in common and we have a declaration of trust which covers selling the property.

They now want to move out and rent out their room which is fine by me however they are in a rush and have said they want to move just anybody in which includes that possibility of a couple to enable them to go asap. This is not acceptable as it is a risk to my personal safety, my living environment and to my investment in this property.

I tried to help them find someone suitable, even spending money to subscribe to various websites, but so far we have had no luck. Now they are saying they will just get anyone in - the first person who wants it regardless of how I feel about them.

Do I have any rights or say who will be sharing this property with me? I am at the end of my tether with this. I will still own the property with her some some semblance of cordiality needs to be maintained but the gloves are coming off in our discussions and the situation is getting untenable. :-(

  • have you tried advertising for a lodger, they have less rights than tennants?

    think its selfish of your friend not to consider you as you are going to be the person living with them so you should have some say in who gets to live there, especially since you have been accomodating in subscribing to various sites and helping look for someone.

    i dont think you have any legal rights although you could say that the mortgage doesnt allow anyone to let and it will put the mortgage at risk and you dont want to do that.
