Can I still continue my claim?

I believe I was mis-sold PPI in August 2003. The lady who sold me the policy was not explicit about what the insurance covered (I was selp employed at the time so am not even sure if I was covered) and also implied that I would need to take out the insurance in order to get a loan of that amount. I wrote to Lloyds TSB (who my loan was with) last July stating this, using one of the template letters, but they wrote back and enclosed a copy of a document I'd signed which stated that I had been given full details of the policy and fully understood and agreed to the terms and conditions. They also said that I must respond within 60 days if I wanted to contest this. I didn't reply at the time as I didn't know if I still had a case having signed the declaration. Do I still have a case? Can I still pursue the claim even though the 60 days is more than up?
Thanks,
Ben

Usually you have 6 months from the date of the last letter to take the complaint to the FOS but I think if you either write back to the bank and see if they reply or ring the FOS and ask them if you can take the complaint for you this will answer you query.
Some people on here have had this happen and the FOS have still taken the complaint on.
Good luck0 -

Hi Ben
You had the same response as I did from Lloyds, they are not the easiest to deal with, yet not the hardest of them lol, but do not let their standard fob off response hold you back.
As Marshallka says you can contact the financial ombudsman service where they will advise on the best action here:
http://www.financial-ombudsman.org.uk/consumer/complaints.htm
There are contact details of the FOS on the link, also details of the procedures, but if the 8 weeks have passed you are free to continue to complain to the FOS anyway, you will also find a complaint form you can download from the site, or if you ring the FOS they may offer to send one through the post anyway.
If you decide to go to the FOS, also send lloyds a copy of your completed complaint form for their records, this may even help your complaint, if this does go in your favour from lloyds then just inform the FOS.
They should enclose details of the FOS and the leaflet in the final response, but there is no harm in contacting the FOS anyway and see what they have to say.
Good luck with this and give us a shout if you need any help/info.;)The one and only "Dizzy Di"0 -
That's great, thank you both for your advice. I'll definitely pursue this with the FOS in that case, will let you know how it goes.0
