First Plus PPI

In 2005 I took out a loan with First Plus who told me that I could'nt have the loan without the insurance this amounted to about £6000 one off payment. I have recently written to them requesting the loan agreement, which they have sent, but there is a box ticked to say that i did not take the insurance out. I have telephoned them and they are stating the same, that I didn't have the insurance. they wouldn't let me have the loan originally without it! can anyone help?

    Yeah, sounds like Firstplus all over. Just to double check here, you did not use a broker at all for this did you?? If you did then you make the complaint agains the broker and providing this was after 14th January 2005 when all sales of insurance became regulated you should be ok to use the FOS for the complaint if they turn it down. You can easily see on the agreement if the PPI was added. If it was then it would show an amount of the credit and then the PPI amount??? If you still feel you took loan insurance out then make a complaint.

    What date in 2005 was the loan take out if you did use a broker?


    Just take a look at the link here and see what you can add and delete from the template letter. Its always best to do your own from this. There are lots of reason on there for the misselling so pick out the ones that are applicable to yours.

    You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

    After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.

  • Yes, First plus are telling me that I did not have the PPI! They would'nt process the loan without it. the agreement has been handwritten on one piece of paper, one side is handwritten with the amount of loan, then the charge for credit and amount payable, then the payment protection has been ticked as "No" which wasn't done by me. There's no spaces or room to state the amount off PPI any how on this form they sent. What do i do?

    This sounds very strange. Is it a proper agreement signed by you and them? I cannot think that they would give a loan without the PPI from experience on here. Could you not request the agreement again using a letter asking for it under section 77/78 of the CCA and they have to reply in 12 days by law???
  • Thanks I'll try that, its in two sections on A4 paper the figures are handwritten down one side with the PPI underneath that whch has been ticked "No" then under that theres a box that they have signed, and down the other side is where we have signed, it just seems a bit odd! I didn't tick the box "No". I know i definatley took it out coz it cost me £6000 at the start of the loan and I had to pay it to come out of it. but i have no original paperwork now, this was 30th January 05.

    Hi Teresa

    I note you state you have no paperwork, if you've no agreements, request for a copy of this from the finance company, check to see if there is a charge first, normally they charge a £1 cheque or postal order payment, then request this in writing.
    Post by recorded delivery is the best thing when requesting documents, and also a Subject Access Request (SAR) may also be a good idea, however there is a £10 cheque or postal order charge for this but they have to send all the information they have on you within 40 days.
