IVA @ bank charges can i get them back??

Can i claim my bank charges and credit card charges back as i am 3 half year into my IVA and if i can could i pay this IVA off with it or would IVA people want money and i would achieve nothing by claimint.... Can i get a mortgage???????????????????????????????????????????????????

Hi denandy. We went through the letter writing stage a year ago (using the templates from this site). got to the point of offer letters from natwest as predicted by martin at the time before the test cases etc. When we called natwest who were part of our IVA they told us the amount offered would be deducted from what was owed by us. in effect we could have gone through the whole reclaim process and still had our IVA. We were fortunate enough to be able to make a full and final offer which was accepted and our IVA was sucessfully concluded in October 2008 and we are free. Our creditors have all marked our credit files as repaid so in theory any future payments will come to us? Seems quite apt as it was the charges that pushed us over the edge in the first place. When we talked to our IP we were told that reclaimed charges would (if paid) come into the "windfall" category and as such would need to be entered into the fund, though NOT as a F&F payment.
