PPI reclaim success versus arrangement

I did post this question earlier and apologies if it was in the wrong area.
My partner has received an offer from M & S for a refund of PPI.
As this loan is currently under a payment arrangement due to ill health on my part and reducing our income significantly, can they insist on refunding the charges and offsetting them against the loan arrears?
As I said earlier, it is not our intention to avoid paying back the debt but due to financial hardship this money would be very helpful for other priorities. If we didnt have to accept it being offset against the loan could they then refuse to continue with an arrangement?
Your advice and ideas would be very much appreciated!

You have posted in the correct place so not worry.;)
As far as I know if there is anything owing, (other than the norm), they can insist on doing it this way, but maybe you could write to explain you are in a comfortable arrangement now and if it were possible if they could repay this directly back to you.
I am hoping this can be clarified by someone else who have been in the same situation, so please keep checking for further posts, good luck and its good news they have made an offer.:T
