any help please

We have exchanged contracts on our house and are due to move out on Thursday. The people we were buying our new house from have decided today that they can't do the Thursday now and have said they need another 2 weeks. They have messed us about all the way through and we are not sure how to play this. We will have to store all our furniture, cat etc....Everything was geared up for next week and now we don't know whether to go ahead or not. Any suggestions are welcome!

    I'd call their bluff and tell them the deal is off unless they stick to the original agreed date.

    Either way you might have to find temporary accommodation, so you have nothing to lose by upping the ante.

    check again - the OP says that they have exchanged contracts and that means both parties are legally obliged to go through with it or get sued for breach of contract.

    Wardlc - Are your buyers in a chain? Get your solicitor to find out what's going on and push to see if they can reach a compromise - a week later for you, a week earlier for the purchasers.

    And don't put the cat in storage....;)

    Legally, they cannot do this.
    Legally they MUST move out.
    If they try to change it now it really f00ks everything up. The deal's off and a new contract might even be needed, there'd be problems.

    Let THEM move everything into storage ... tough.

    That is the whole POINT of exchange: no going back.

    Tell your solicitor "no".

    I'm not sure. OP says they have exchanged contracts on their own house and then that the people they are buying from are being difficult. I think that's a different transaction.

    I read it that they have exchanged contracts on their sale, which I am not suggesting they mess about with, but not on their purchase, so the ball is in their court on that.

    However if they have exchanged on the purchase then they need to make it clear to the vendors that the original completion date is not negotiable.

    It totally depends if the completion date was in your contract - if not I don't think you can challenge them :confused:

    But the OP isn't "challenging" anyone. All they want is to stick to the original agreement. It is the vendors that are messing them around.

    We need the OP back to clarify whether their purchase has been contractually agreed and signed yet.

    No way should they jeopardise their own sale. If the vendors won't co-operate and stick to the original date then they should look for another house, and rent in the meantime, which they would have to do anyway if the 2 weeks postponement was to happen.

    The date on which they have to move out is part of the contract.
    If they break the contract there are consequences which your solicitor can deal.

    when we sold our house once the contracts had been exchanged and a date to move agreed you have to go, stick to your guns tell them no there can be no mitigating circumstances they have signed the contract, your solicitor should be dealing with this,its what you payed for, hope you get to go on day you should good luck
