GE Money! help needed please!

Hi All,
l dont know if anyone can help me but we took ge money through mcol for charges and ppi, they then 4 days later put in their own claim. (not a counterclaim) We sent our acknowledgment and then wrote our defence (all on line) telling them of our financial situ and that we admitted to part of the claim but not all and offered a payment plan. (with me so far!!)
Heard nothing or a while then a letter from their so called solicitors dept came, saying that as we know a judgement had been entered against us and that to comply with it we should pay £125.00 per month with the payment slips provided. (that was £115.00 more than we said we could afford) We rang northampton court who said nothing had been recorded against us, so we wrote to ge money and said that they seemed to have ignored our defence, again heard nothing until today when a allocation questionaire arrived.
So do you think they have been telling porkies, trying to intimitate us into paying or do you think we have got a ccj.
Sorry this is so long winded but we're really confused.
Any help greatly recieved. X

    Sorry, but if you wrote a defence the case should have been moved to the court nearest you. Where is that?

    Thanks ras, yes it has been moved to the court nearest us but what has confused us is that they've said a judgement has been entered against us, we thought this only happened if we didnt stick to any payment arrangement made. As l said they never anwered us as to whether or not thet accepted our offer.
    The allocation questionaire askes if we want to try to settle out of court which is what we've tried to do. Hope that's a bit clearer!!

    Hi Ras, thanks for getting back to me, l have'nt got my papers to hand but if section 11 is the finances bit then yes we did fill that in, we also admitted some of the claim from them, minus charges and ppi and offered them £10.00 per month as OH will be off sick due to double hip replacement, so it was point less to offer an amount we would'nt be able to stick to, but it seems they've chosen to ignore all of that.X

    We did everything online, that was the defence (that was the last thing we did ) then heard nothing until the intimidating letter that l mentioned earlier saying about the judgement. We'd heard nothing in writing from northampton .The papers we have recieved now tells us to send them back to our local court.

    Yep, it says:

    Dear ....
    As you are aware judgement has been entered against you.
    Payment in accordance with the terms of the judgement must be made direct to the lewis group, who will manage and monitor payments in respect of the above action on behalf of CL finance ltd and ourselves.
    The judgement order states you must pay £125.00 every month commencing 31st dec 2008.
    Enclosed please find payment slips for your use.
    We of course retain control of the court action and should any payment be missed we shall not hesitate to proceed further through the court. Should you have any quereies lease do not hesitate to contact us.
    Yours faithfully.



    Ras, we did not get any notification from northampton that this was the case, would we have heard from them? When we rang NH they said nothing had been registered so you can see why it's confusing, l thought we'd followed all the proper procedures.

    Or write to them tonight and ask them for the date of the judgement and at which court it was entered and send registered post tomorrow. You need to keep a papertrail here.

    Can you also try ringing NDl tonight or tomorrow morning.
