Tax rebates are treated as Capital not Income. Applies to HB, CTB, IS, JSA(ib), Pension credit and pretty much any other means tested benefit.0 -
Real, Im oap and confused, was that a yes they can take it ?or no as it's classed as Capital,?sorry to be so dence, thanks in advance,0

yWhat Real means is that the tax rebate will be classed as capital, in other words savings. You can have up to £6000 capital before the affect your means tested benefits and the maximum allowed is £16,000.0

Tax rebates are classed as capital as Real1314 has said so unless you are already very close to the 6k limit / or are lucky enough to have a 6k plus tax refund it wont affect your benefit.
However if the rebate takes you up to or over the 6k limit then yes it wil have an effect on your benefits.
Hope this helps/ clarifies:j0 -

No. They can't take it as weekly income. They will treat it as capital, which would only affect you if you have more than £6,000 in total after the rebate. As a pensioner, if you had over £6,000 it would reduce your benefits by £1 per week for every £500 over £6,000 (subject to tapering for HB, CTB and Pension Credit)0 -

It would indeed be classed as capital rather than income, but it would be disregarded for a year before being taken into account (which only matters if you have over £6k, and even then would be unlikely to make much difference unless it was a very big rebate). Hope this makes sense.0 -
