Tenancy Agreement - 2 days in and realised it's a mistake

    You have entered into a legally binding contract.
    There is no way out. You are responsible for it all and have to pay it all.

    Now, what you can do:

    Contact the agent/LL and explain your situation. Tell them you want them to find a new tenant for the property as you will not be occupying it.

    The LL has a legal responsibility to try to find a replacement tenant.
    You have a legal and financial responsibility to cover any expenses he incurs doing this and the rent from the start of your AST until the date a new tenant moves in.

    This might mean he has to pay his Agent again, or there might be advertising fees.

    If you're lucky and they find somebody quickly you might get off lightly.

    You mean say if a tenant signed a legally binding tenancy agreement and so did the agent on behalf of the landlord and the tenant was given keys on the agreed start date and started to move stuff in but was chucked out on day two (due to the landlord having instructed two agents), something like this:

    Both contracts are binding IMO. EDIT Unless the issue below applies to Cameron1983.

    If the tenancy agreement is not signed in the presence of the LL or agent ther IS a 7 day colling off period iin accordance with the distance selling regulations.

    So if you didn't sign in the presence of the LL or agent you may want to check out the Distance Selling Regulations.

    The sooner you talk to the LA, and/or LL if you have their contact info, the smaller your outlay for this error of judgement is likely to be, provided they can can find an acceptable replacement tenant. The LA will have heard it all before but just work with them, check every now & again that they *are* re-advertising. Be aware that if they can only let it at a lower rent because of market conditions they may look to you to make up the shortfall between the lower figure & what you were contracted to pay for the period of the original FT..

    The alternative is that you grit your teeth, move in & ask if you can sublet one of the rooms, the income from which you can use to to offset against any increase in work travelling expenses. As Paintpot says, you can use technology to suss things like work routes etc out in advance. Good luck.
