Need some advice.

Could someone please advise me where i stand. I'm renting a house and would like to leave but have been told by the agent that i have to give a months notice which is fine, but last night i was sorting through some paper work and realise our contract hasnt been renewed since aug 2008. Do i have to give notice if dont have a new contract. I would like to leave here as soon as. I just dont want to lose my deposite.We have been good tenants, the house is in good order (prop better than when we moved in!!) and have never missed any rent due. Where do i stand on this coz at the moment i dont have a clue.

    The contract doesn't need reneweing, it automatically rolls on.

    Yes you do have to give notice and that one month needs to end on your rent day.

    eg. You can't give notice today 6th February to leave on 6th March unless today is your rent day. If your rent day is the 18th then if you give notice today, the notice ends on the 18th March.

    You're not being held a prisoner - you can move out when you like.

    But ... you are liable to pay the rent until you terminate the TA correctly.

    Just to be clear,

    The notice you most serve is one full calander month ending on the same date in the month that the fixed term ended (NOT rent due date). This may or may not be a rent date, as rent due dates are sometimes different that contract start/end dates.
  • So if i give notice now I can still leave when i want but will i lose my deposit?
    Help i really dont understand all this!! (Im not thick honest):-)

    You'll lose your deposit to cover outstanding rent and they will then pursue you if there is any additional outstanding amount - be that more rent or damage to the property.

    You must understand that it's completely unfair on a landlord to just up and leave without giving them the notice which allows them to find another tenant.

    You cannot just leave without any kind of kickback. The only time you can leave without giving notice is on the exact day that a tenancy ends - ie. back in August last year.

    You have to pay rent until the end of the notice period. Whether or not you choose to live in the property during that time is up to you. You won't lose your deposit unless you owe them money.
