Getting Deposit Back

Hi,

I am renting with a landlord, I have been living in the property for 3 months.

When I signed the tenancy agreement the landlord didn't have a copy to give me and said they would later. I forgot about it until someone else moved and the landlord said the same thing to the other person moving in.

I paid my deposit by cheque but lost the receipt I was given from the landlord.

What I am worried about is at the end of my agreement about getting my deposit back.

If they do not give my deposit back and I take them to court, what do I need to provide as evidence that I gave them the deposit (I.E. get another receipt of the deposit and copy of tenancy agreement)?

I did not sign an inventory list. The reason I ask this is because they have had trouble with the law and I am not 100% confident that they would give me the deposit back.

If you need anymore information, please let me know. Any additional advice is welcomed.

    Does your landlord live in the property with you?

    write to the LL and ask for a copy of the AST and also ask for an inventory. There is nothing stoppping you writing your own inventory and signing it and sending it to the LL. if he does not respond - then contact all 3 deposit schemes and ask if your deposit has been lodged.

    That is correct.

    You said you paid by cheque. The bank will be able to provide evidence of the amount paid if necessary.
    Worry about it if/when a dispute arises over the return of the deposit.

    Thats correct. You arent a tenant but a lodger. If there are any problems at the end of your stay (lack of contract doesnt mean there will be - lodging agreements are quite informal in some cases), and your LL wont negotiate, you will have to take them to small claims.

    You will be able to get a copy of the cheque from your bank and a bank statement will show it has been cashed (be more careful with recipts next time!). Make sure you take plenty of pictures of the condition you leave the room in on exit. Thats all you can do really.
