Bailiff advise please

    I've just phoned the number and spoke to his wife (who was lovely) and confimed he is in surgery at the church hall tonight.

    I think I might go down, at the very least I can find out how much they can help, or like you say get a halt on it until I can speak to the council properly.

    fully acknowledge the debt however would like them to deal with it, also mentioning the levy is invalid because we hadn't agreed to it

    One minor but very important point

    You don't have to "agree" a levy.

    The Levy is invalid because they've included and charged for a walking possession, which you did not sign at the time of the levy.

    Good luck - if I might be so bold as to make a further suggestion, make a written list of everything you want to say, and use that when you phone them. I know it's difficult to deal with things like this, but if you use a list, or something similar that works for you, then hopefully you'll be ok.

    I've been to see him. And I cried :o

    Ok, what he's going to do is speak to the head of revenues Monday morning and explain everything and see if we can get it brought back from the bailiff, he is also sending a letter to her and the department about it but obviously it wont get there till Tuesday at the earliest and that's when they say they are coming back hence the phone call. He is going to try to arrange an appointment for me to go to the council on Tues and set up a payment plan, he's also given me the head of revenues number at work to phone myself on Monday during my first break to see whats going on.

    I'm feeling a lot better, I'm just trying not to get my hopes up in case they say no.

    One thought - there is usually a council tax e-mail on the Council webs-site (ours is [EMAIL="ctax@..gov.uk"]ctax@..gov.uk[/EMAIL]). If you can find that send a brief e-mail with head-line for attention mrs head of revenues, advising that you have spoken to Cllr x and explained your situation and are looking forward to meeting, but please can she halt bailiff due on Tuesday until after meeting?

    Well done for going to see him. I hope that something can be done - certainly looks as though he's going to do his best for you.
    I have had personal experience of a 'Business Rates' (not council tax as such, but same department) being passed to a bailiff - I spoke to our local (Wiltshire) Council Collections Department, after 'bailiffs' first call, and was able to negociate a payment plan - plus I found out that I was eligible for a reduction - so it certainly does pay to talk to them.

    I phoned the lady at the revenue department and she has agreed to suspend the bailiffs till next week on the understanding I go in for a meeting and set up a payment plan before then, if I start a payment plan and stick to it she will call them off completely :j I've made an appointment for tomorrow and I am going to take an income and expenditure form in and sort some sort of weekly payment out.

    This is good news.

    This is a priority debt, which means you need to pay it even if you have to reduce payments to other people.

    On the other hand, do not offer more than you can realistically afford and keep them posted IF there is a problem with any payment.

    Other than some rent arrears from the same period (we had a bit of trouble a while back with the family situation and health problems) and housing benefit overpayment (which we're appealing) which I am paying off on top of my normal payment I don't have any other debts so I'm quite lucky in that respect, its just unfortunate they're all priority debts but my council who I rent from have been fab and very understanding about the rent arrears because I kept them informed every week.

    I do have a debt with Barclycard but its been passed on to Aktiv Capital dudes and from I've read from the searches on here then thats not much to worry about. Good job I did a search though, I was about to take up their offer of £30 a month :rotfl:
