it rather sounds as if your landlady may have refused to use the Deposit scheme Arbitration scheme. if she has done this - your only way forward will be to take her to court .

but - phone the scheme first and see what the state of play is...

Sorry things have moved on slightly since original post , the deposit withthe TDS,it was referred to them by the agent and by myself as the landlady has put in unreasonable claims. We had to leave the property for a number of reasons all related to the condition of the house including extreme damp(we involved the enviromental health, who made a report saying the heating/ventilation was inadequate). One of the LLs claims included a bill for damp proofing!!!! she claims we didnt heat or open the windows!!! there have been other claims but we have seen no evidence or paperwork thesehave been sent to the TDS on 10th May,the information i was given regarding decisions about the deposit was that it would be completed in 30 working days then a further 10 working days for payment. Now it has been over 40 working days,(a long time when your short on cash).I have checked the TDS website and the case has closed and letters have been sent (dated 7th July),still no letter. My advice to tennants waiting for a decision from the TDS is,Dont expect it to be dealt with quickly, that doesnt happen, will post the decision as soon as i know it ,thanks for listening:confused:

none of the 3 Deposit Schemes are able to make decisions within the prescribed timeframes as laid down in the 2004 Act..... DPS can take 3-4 months to finalise an arbitration...
