Time limits for claim?

Back in August last year my OH had a (what he thought was) a minor bump with another car. V Little visible damage, swapped details etc but he was happy to settle without getting insurance involved. They involved insurance co. (as was their right). We hadn't heard anything by Nov so got in touch with our insurance and they said they were waiting for medical reports. We still haven't heard anything. Any ideas if there are any time limits re this or anything? In the meantime we've renewed our insurance - no change to premiums to date. Thanks for any help

    It's 3 years for an injury claim, 6 years for damage claim.

  • 3 years is the maximum time limit for the claimant to issue legal proceedings against you for injury (unless claimant is a minor). If it's a small-ish injury claim (as you suggest from the impact), the claimant has already intimated the claim and it is in hand then it's more likely the claim will be settled this year.

    It's not unusual for you to hear nothing and it's unlikely your insurer will keep you up to date on the third party claim to be honest, unless there is a dispute and they need to refer to you. They probably will not advise you as a matter of course, even when the claim is settled.
  • 3 years to issue proceedings. Get your PI claim in as quick as possible - the longer you wait, the dodgier it looks. most firms will not touch claims within 6 months of limitation.
  • The OP is the fault party, the injury claim is the other side.
