Underpaid at work...my rights

Hey all, just a quick question as I was wondering about my rights for where I work (a pub in Manchester)

I recently went through wage slips as I thought I was underpaid this week, however I also noticed I was underpaid for weeks dating back to October! Sneaky Mitchells and Butler pubs!!

I was wondering what are my rights when it comes to claiming back these hours, as I did hear one of my managers mention under his breath that you can't claim back after 4 weeks have gone by.

For your info, I get paid weekly, and the only proof I have of working during those hours of underpayment is the calander on my phone where I write down my hours.

    Um its word against word you so you're unlikely to get anywhere.

    Make your own timesheet and get manager to sign it so you have written proof, otherwise get a job elsewhere

    Were you underpaid as in number of hours worked or hourly rate? If it is number of hours, then I'd ask for copies of timesheets/rotas from your manager (or HR department).

    When you say underpayed. how much are we talking? If its like 30mins worth a day, you might find that your lunchbreak or other breaks arnt paid and they are "just" taking into account for that time. However if that is so you should be getting those breaks, not being made to work through them....

    If its more than that then there is something more seriously wrong. In theory there isnt a limit to how long you have to take this up with them (well there might be, but we'd be talking years not weeks), however without evidence it will be very hard to prove. Ask for your last couple of weeks of timesheets (or as many as you can get hold off). If the system is anything like the Beefeater system where you have to clock in and clock out and its all recorded in central database, that information should be sitting there and readily availible. Then compare to what you know you've worked and what you've been paid.

    Otherwise keep your own timesheets and have your managers sign them, for the future and hammer them should they get it wrong.
