just been scammed

ok it was only for £21 but paypal have put a tempory hold on this amount while they carry out a fraud investigation.having been on the phone to them im not covered by seller protection because i sent the item to an unconfirmed address.they basically said never send an item to an unconfirmed address to which i replied surely thats against ebays term and conditions and the buyer could put in a non performing seller dispute in with ebay? their
reply was ebay had nothing to do with them. so either send the item and lose the money off paypal or recieve a strike on your account from ebay for not sending.obviously im less than impressed.
the person i spoke to was also under the impression that ebay do not own paypal, they were two sperate companys and had nothing to do with each other. was getting nowhere explaining that paypal are owned by ebay.
anyhow the person that bought the item has not been suspended from ebay and has %100 feedback but looking at their buying history they have bought a load of goods in the last 3 weeks.
can i now put in a dispute with ebay ie non performing buyer? or do i have to wait 7 days to do this.the item was bought on wednesday and was delivered this morning.i actually confirmed the address before i sent it by finding their phone number off directory inquieries (their ebay contact details were false)
would it be better to neg them now and risk a neg back (im on 400 %100 positive) or win a non performing buyer dispute then negging them?

or just put the whole thing down to experience and forget about it.but ring them up at 4 in the morning every night for the next month (i work nights).
thoughts please and any answers to the above questions?

    I've had the same thing happen to me a couple of weeks ago. heard nothing more from paypal, except initial email asking for the details fo the transaction. the buyer has responded to a couple of my emails, saying he's trying to sort it out with paypal, as it's not his fault. he already has the item, and has asked me to be patient, as the money has left his account, but has been taken back from mine. in my case i'm going to be patient, as i figure he wouldn't bother replying if he was not being truthful. i've threatened negative feedback, although he only has 7, so it's not a lot for him to lose.
    try contacting your buyer...and good luck.
    Ps mine was only for £28, but it still grates, its good money (or a good 360 game - either way)

    If i every get !!!!ed over by PayPal i will just refuse to use them ever again. On their homepage it says "We work hard to protect sellers" that should be "We work hard to protect ourselves" :rolleyes:

    can i file a non paying bidder through ebay on day 7 and can i do a charge back through paypal to get my £21 back ?

    everyone THINKS they're covered by paypal, but i'll bet more than half the transactions that go on aren't
    money saving my @rse.

    A non performing buyer will only issue you with a strike and get your fees back- nothing more. Probably best to go down the paypal route. Unfortunately a lot of buyers have unconfirmed addresses.

    I take it they paid you £21 then paypal have froze this money ?

    Well i want them to get a strike and i also want to leave negative feedback without getting it back.

    yep i got the £21 through paypal ,sent the item then paypal took the money back.so can i still do a chargeback through paypal?

    If I've followed this correctly then the buyer got his money back as the item was not delivered?

    If so you can now claim against the RM for a non delivered item, so you get your money back (item cost only), plus you can now do an NPB on the buyer as he has no longer paid. If th ebuyer does not respond to the NPB then, and only then, can you leave him feedback without him leaving you any in return. If however your buyer responds to the NPB then he retains the right to leave you feedback, but can't stop you getting your FVFs back.

    no the item was delivered last friday but they paid with a dodgy paypal payment which has been withdrawn from my account by paypal so i have no money and they have the item.they are still on ebay (with %100 feedback) and selling items.so can i do a chargeback on the paypal account i was paid with in the first place.
