Help- Claimant must request further case amnagement directions?

Thanks for taking the time to read this, if anyone can make sense of this I will be very grateful!
In October I was sent a letter by the County Court saying that my claim would be stayed until 30th of Jan 2009. However if I do not request further case management directions by 27th Feb my case will be struck out.
At the time I decided not to contest the stay and wait for the outcome. I called the court today regarding the 6 month extension of the OFT Test Case, only to be told that I should do what the letter says.
I really don't know what I am supposed to be doing now, I have searched this site and the CAG site forums but it doesn't seem that anyone else has had a letter like mine!
If anyone can help me with a template letter or point me in the right direction , I would be very grateful.

    From sounds of you you should request the further directions hearing where you ask for your case to be stayed for a further period (ideally to tie in with the judgement you are waiting for in the other case insert that date) and a direction for costs I expect to be "in the case".

  • What "track" is your claim on? I can look for a form, although you could draft the directions yourself in a letter and send that to court and defence

    Write to the Court manager, something along these lines:

    Dear Sir,

    Claim No; XXXX
    Scamster v Your Bank

    Further to the Directions given by District Judge XXXX dated xx/xx/xx which stayed the above claim until 30th January 2009, I am writing to request further case management directions.

    Yours sincerely,

    The chances are that the stay has been automatically extended , but it doesn't do any harm to have something in writing.
  • I would also further to the above letter suggest the directions - potentially means can be dealt with by agreement avoiding costs and even an attendance.

    I forgot to mention that the 'request is to be made to the court setting out the remaining issues in the case.' so maybe it is not as simple as
    asking for the stay to be extended?

    I don't even know what the case management directions are supposed to be. To be honest I am finding it extremely difficult to get my head round this!
  • I take it that by asking for further case management directions, it would go on to a further case management hearing in order to get the stay extended?
    Please correct me if I'm wrong!
  • Thank you both for your help, it makes sense to me now! I received a letter fron the court today to let me know that the case has been stayed until May, so I don't have to do anything till June.
