Thanks again for help, I have checked the welcome finance paperwork again ( which included a leaflet from FOS) and their final response actually did not come till feb 09 so should be ok however they said in letter that should I want to make a further complaint I need to do it with FOS so do I do this or write to Welcome finance again before FOS ??

If that was the final response, you can now go ahead to the FOS, did Welcome state it was the final response?
If so they should also state if your eligible to go to the FOS, if not write back to Welcome and ask them to reconsider.

Also to just give you details of the FOS here:

It tell you the procedures of reclaiming, and if you do end up going to the FOS, you can download and print a complaints form on the link or ring them to arrange to post one out to you, also enclose copies of correspondence from Welcome Finance.;)The one and only "Dizzy Di"0 -

It said final response at top of letter and then states further in letter ( after saying how all forms detailing about ppi and its conditions were signed at time of loan and how we had 30 days to cancel ppi ) that should we remain dissatisfied we can escalate our complaint to FOS they also say should we complain they will ask for it to be dismissed ( is this just scare-mongering)

I would not bother writing back them to for them to reconsider, I would now go to the FOS.
Do not worry about their comments, you have your reasons why this was mis sold so go for it now with the FOS. I think this is a common statement made by Welcome.
However, I would write back to Welcome to make them aware you are now taking your complaint to the Financial ombudsman service for them to investigate, it may change their minds, its been known to happen, if they do let the FOS know, but if you can send them a photocopy of the complaint FOS form so they have their own copy. I am also attempting to claim back my PPI from welcome - I've used the template letters - hoping for a refund around the £8k mark!! Hope all goes well for you - I'm glad I'm not the only one fighting Welcome.
