Selling House Can't Find My Joint Mortgagee

In 1995 jointly purchased my house with then partner. we split in 1996 and he signed the house over to me[ this was not done through a solicitor ] I informed the mortgage company but they would not put the mortgage solely in my name as my income at the time could not generate the mortgage. However I have been paying the mortgage since then on my own. I now want to sell . Do I have to seek expartners permission ? If I can't find him what will happen? :rolleyes: ANY ADVICE PLEASE!!!!!!!!

You will require your ex's permission to sell the house, as he is probably still on the deeds. Without his say so, you'll have a very hard time selling.In a rut? Can't get out? Don't know why?

Thank you for your reply. Do you know what permssion would be acceptable ie a letter from him ,would the letter have to be witnessed by anyone , ie; a solicitor. Ta0

He will have to sign the same documents that you have to sign. They will need to be witnessed, too. He'll also have to present proof of ID, etc. That's to stop you getting just anybody to sign saying they are him.In a rut? Can't get out? Don't know why?

I don't want to upset, but he could be legally entitled to some profit from the sale of the property, even if you have kept up the mortgage payments on your own. I should hope he would have common decency not to demand part-share.0

This happened to me, except I knew where my ex was. The estate agent wouldn't market the house without his signature, and although he'd only paid the mortgage for 10 weeks as we then split up and I had paid it alone for 4 years, he was indeed entitled to half of the profits by law as his name was on the mortgage!I love this board, have "virtually" met so many lovely people, people I am honoured to count as friends.
