Can I claim?

As part of a long running saga, I recently paid £2000 on my credit card for another (reconditioned) engine for my car. It had to go back to the garage as they had mucked it up badly and had to sort the problems. 7 weeks later it seems the garage has gone bust. We cannot contact them at the moment, but are trying. They still have our car (undriveable) and the work that has been done is useless. Can I claim back against the credit card if all else fails?

  • Is the reconditioned engine faulty in any way?
    I can't see them paying up if the garage you left your car in has gone bust.
    The best you could hope for is another reconditioned engine but not a car.

    Give it a go, Mr Jones is correct in his post that you will not get a new car - maybe a new engine though, claim under section 75 of the consumer credit act for goods/services not delivered.

    I wasn't thinking of claiming for a new car, simply for the money we spent on the engine - since it didn't do what they promised. And I expect the warranty it was covered by is now worse than useless!
