HI,was wondering if you could please give me some much needed advice..
i bought a car of, ac, on the 12/01/09 i picked the car up on the 13/01/09 i got the car home and parked it on the drive,i did not use again untill the saturday 17/01/09 on my way to work i noticed a knocking noise coming from the front of the car.at the start when i went to buy the car i was told it was a one owner car,the car would be fully valeted, the car had full service history i was also given a full tick sheet stating all visual checks inside and out had been done also it had a full mechanical check.on picking the car up the first thing we noticed was the back wiper all the rubber was split,we pointed it out to the salesman who assurd me it would be orderd and changed, still waiting,we thought the car had been valeted untill i got in the car on the wednesday 14/01/09 to check if it had been cleaned,i could not believe the state it was in,it was filthy,i know i should not have cleaned the car but i had to spend over 2 hours just cleaning the inside they had just wiped a bit of polish in the car to make it smell that it had been cleaned,i also notice for some reason they had wiped polish over the engine or spilt some on the engine,i do not know why they did this.when i checked the service history i noticed it was due a service called intrim,i was told by, ac, if a service was due they would do the service and stamp the book, they did neither,i booked the car in for a service with peugeot on the15/01/09 for the monday 19/01/09 on this service they found the drop link bars were worn and this is where the knocking was coming from, also front wipers worn and need to be changed, windscreen badly scratched due to wipers never being changed, back wiper badly split, went back to ac. with peugeots findings and they basically called peugeot liars and said they do not know what they are talking about,we told peugeot what they had said, peugeot told us to go to there mechanics and they would show us the problem, which they did.concerning us being told one owner i received the documents back and we have since found out it was owned by ac finance but the car was either being rented or leased to an nhs trust in warickshire,we was never told this only it was a one owner car,if we had known it was rented or leased we would not have touched the car.we went to ac 21/01/09 to reject the car but we found the genral manager to be very intimidating and his salesman were outside watching us so we did not give him the letter, due to feeling intimidated we just agreed to have it repaired just to get away,to which the manager said i like it when i have to flex my muscles on the knowlege of the law.we went back on the friday not to have the repairs done but on this occasion to give him a letter of rejection, which we did and he said we have no right to reject the car,we brought the car home and have not touched it since,we have had no contact what so ever from ac.
can you please give me any advice possible on this matter
thank you so much from a forum newbie

I letter from a lawyer is necessary to reject the car officially as it was not decribed to you truthfully. The lawyer, or citizens advice, will know all the sales of goods act conditions which have not been met.
Have the letter delivered recorded delivery and drive the car back and hand the keys to the smart salesman and see how smart he is then.
A letter to Arnold would also not go a miss.
Have a read of this you may get some idea of what else you can do.

Hi tracy,
Having been through something similar myself recently I can identify with what you are going through believe me.
The problem is when you collected the car you should have checked to see whether the car was in order and that the valeting had been done. As you signed for the car and took it away then you have technically accepted it in that condition, so legally you are on thin ice with that one I'm afraid.
However, because the drop link bars were worn then this was a breach under the sale of goods act as 'not fit for the purpose'. The dealer should have been liable for these repairs, but because you had it done elsewhere then your rights are rather limited now.
When you purchase a car you have a limited time to satisfy yourself that it's of 'satisfactory quality' and 'fit for the purpose'. However, if you find any faults then you must give the supplier the opportunity to rectify them. If they do not then you have the right to 'reject' the vehicle.
My advice would be to write to Arnold Clark stating your grevences and quote the 'sale of goods act' and give them the chance to rectify any further faults. Give them 7 days to reply and then either write to them again or contact trading standards/CaB.
My gut feeling though Tracy is that you have passed the threshold for rejecting it, but you should be able to get the repairs done at no cost to yourself.

i cant really be bothered to read the OP as its too confusing, but i assume they took it to another garage before giving the person who sold them the car a chance to fix it?0

Yes that's correct..0 -
It was a one-owner car. The V5 will confirm as such. It matters not how many people drove it.
Drop links are wear and tear items, and easy to replace. You may also want to check the anti roll bar bushings while you're in there, they cost a few pence and are worth doing.
The wipers and screen would annoy me more than anything.0 -
I buy lots of cars from the NHS. They are all one owner, it's just they may have been used as a pool car or by several district nurses or maternaty type ones.
However, I strongly advice you you use paragraphes as that was very hard to read...
When you collected the car you will have signed and dated it on the invoice. One of the points near the signature box is that you have examined the car and accept it's condition.
If you weren't happy with the car on the 17th Jan why didn't you take it back to AC with a list of things you'd like looking at? As in the eyes of the law you are meant to give the dealer so many chances of sorting it out.
As you signed to csay you accept the car and you failed to give AC a chance or sorting it out, I personally think you will be wasting your time with a Lawyer or a trip to the CAB...0 -
If AC have offered to repair any faults then they have fuffiled their obligation under SOG so i don't see what reason u have to reject the car.
If there is only one keeper listed on the Reg doc, it is a 1 owner car regardless of who actually used it. - So u won't be able to reject it on these grounds.
There is no excuse for poor customer service, but unfortunately theres not much that can be done about it.
Take them up on their offer of repair and make sure you thoroughly check the car before so everything gets done! If you find anything else later there is little or no chance of them doing it as it sounds like they are already not your no1 fan.0 -
just to update,
i will do it slowly so as not to confuse some people.
i have now swapped the car with ac, after a lot of huffing and puffin
they let me swap the car, i think after being contacted by their head office
and a great lady from a paper called the daily record
they were not very happy yesterday, sat, when i went to pick the car up.
left no petrol in it, made me tax it, but hey if it means i dont have to go near the place again then i will be happy.
thanks for the advice
