dla and ib or income support?

A friend of mine has asked me to post this question.
She is Disabled, gets mid care & high mob, she also gets IB. As she doesn't get income support she is not entitled to any premiums.
No one gets carers allowance for her either.

She lives with her pensioner parents.

Is this the best option for her or should she change to IS?

Thanx in advance;)

I claim IB along with DLA (med care and low mob) but these give me premiums which allows me to get a IS top up

Don't think you can change because it seems a better option.

The contribution criteria for IB were met so that is what is paid.
  • I dont think she can pick and chose tbh,but as she doesnt have her own home,I cant see that many advantages over what she gets now on I/B
  • I think that if she is entitled to IB, she has no option in choosing what to receive.
Perhaps one of her parents can receive carer's allowance?

From what the OP has said, the persons IS rate would be lower than her IB rate.
The key difference occurs when someone getting DLA Care mid or high lives alone (or no-one over 18 with them) as they then get a Severe Disability Premium included in their IS, and it's worth over £50 a week.

One of the parents could claim Carer's Allowance though - they will not actually get the Carer's Allowance as it overlaps with State Pension - however they would then get a Carer's Premium on their Pension Credit if they currently get it - worth about £27 a week
  • Depending on how much IB your friend gets she may be entitled to a small amount of IS as she would qualify for the Disability Premium.

She is NOT entitled to Enhanced Disability Premium because she does not get high rate care for DLA.

She is NOT entitled to Severe Disability Premium as she does not live alone.

Her parents could claim Carer's Allowance but it is unlikely it would be paid in money as they probably get State Pension and you cannot get both of them. It would however get them a Carer Premium which if they are getting other benefits would give them more entitlement.

Also as someone above said you cannot choose between IS & IB, if you have paid enough NI you get IB if you haven't you get IS. (Although this has changed for new claimants from Oct and you all get ESA either income based or contribution based)

Why would they receive it? Attendance allowance is for pensioners care needs and there is no mention that they have any.
  • Thanx so much for the replies.
she just discovered through asking her parents yestreday that her brother ( who is on IS)has been claiming carers allowance(to help the parents out ie keep) she didn't know this ( i will point out that her disability does affect her memory, so she may have been aware but just forgets) I don't know if this changes things.
I only get tax credits myself so i have no idea if this changes things....thankfully this forum has wonderful ppl who care enough to help, so again thank you all.
