    Hi,

They wrote back saying that they will not make me br but would consider applying to the courts for an order to commit me to prison.... But to continue paying any agreement I have at this time to stop any further action.

    Hmmm!

They won't make you BR because you don't own your own home, so there's no potential to get anything back.

    Hi,

I'm not even sure the Councils will do it for Council Tax. I'm Nth London and wrote to my local council asking them to make me br - I had a letter from bailiff saying that as I had failed to keep to my agreement, they would refer my account back to the council for them to take the following action a) Charge on my house - I currently live in a hostel. b) Bankruptcy - yipee! c) Imprisonment - I though a bit drastic.

    Hmmm!

Not going to happen. People think of council tax recovery as a personal thing because it obviously is personal to the individual, but the council are simply trying to solve a problem with the various things they do to recover council tax. The problem is that they are obliged to make every reasonable effort to recover council tax from everyone who owes it, and can cause themselves a fair bit of trouble if they don't bother.

Making someone with no assets anyway bankrupt does not solve their problem, therefore they'd be unlikely to try it.

  • Hi alwaysskintsarah. There are many companies out there that get your details from the insolvency website whre they can see you have an IVA, you then become a target for one of these vultures to get money from you to make you BR. BEWARE! You will be paying them to fill the forms in for you , but to do this they need the information from you which will involve filling in one of their forms first or spending 3 hours on the phone to them while they fill the forms in on line. Therefore, you might as well spend those 3 hours filling the forms in yourself online, saving yourself £500. I had one company ring me up saying they would fill forms in for me for £1200. They wanted me to cease paying my IVA for 3 months to pay for their fees and the £495 fees for BR. It's a disgrace that these companies are legal. PLEASE PLEASE STAY CLEAR OF THEM!!

P.S The forms aren't that hard to fill in. GOOD LUCK!;)

As RAS and others say, that virtually never happens.

So if that is the case, what is the point of going bankrupt? If they cant get in first technically you could just tell them you cant pay. What then?
Does it just mount up for years?
Total Debt -was £14,700 aprox NOW £13,835
    Paying each month-800-850 (hopefully)
Hope to be debt free about aug 2010

They could send bailiffs in if you owe them money. If you can't pay your debts you need to go bankrupt to stop this happening.
