hi i sent a message the other day that i was thinking going bankrupt i now know that ive got to go bankrupt as im going to have live of £67 a week and this is no where near to 1 bill a month i have, i have phoned cccs and they have advised me to just wait as i was on a iva (i paid 1 payment ) to wait for a dissmissed for non payment of the iva or 1 of the 3 companys who i owe money to will take me to court to bankrupt me themselves and that way they pay the court fees, but i had another company who said if i pay them 850, 500 for them and 350 court costs they could do it for me in less than 3 weeks he also said if i wait for iva dissmissed for non payment or my creditors to do it it will last for longer? is this true?what does it mean as i cant find the 850 to do it faster, i was thinking about going to the courts for the forms to fill them out myself i am unsure what to do for the best i want it over and done with as soon as possiable any advice i would be very greatfull for thanks sarah ps i have nothing for them to take so i dont care if have go bankrupt i just want it over as quick as possiable thanks again sarahx

I would not pay another company to do it for you. If you are on benefits, I believe it will cost you £350 only. You are then £500 out of pocket.
I know you want to get it over with but allowing one of your creditors to do it for you costs nothing. £350 saved. And probably a month or two of longer hassle.
Just a thought.BSC No 248

Agree with lensman. Also it is very rare for a creditor to make you bc,although they may threaten it. The usual ones are HMRC,amex and another i can not remember:o .
Not sure CCC's have given you the correct advice here. Try ringing NDL,number in my sig and get a second opinion. What ever you do DO NOT PAY ANYBODY TO DO IT FOR YOU.

Thats one bit I dont understand, as a potential bankrupt person, you have no money but it still costs a substantial amount to go bankrupt, I would just wait it out until one of the companies does it for you.Total Debt -was £14,700 aprox NOW £13,835
Paying each month-800-850 (hopefully)
Hope to be debt free about aug 20100 -
Unfortunately it is almost unheard of for a creditor other then HMRC and AMEX and council tax to make anyone bankrupt for consumer debt, unless there are lots of assets to get hold of.If you've have not made a mistake, you've made nothing0

As RAS and others say, that virtually never happens.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Hi,
I'm not even sure the Councils will do it for Council Tax. I'm Nth London and wrote to my local council asking them to make me br - I had a letter from bailiff saying that as I had failed to keep to my agreement, they would refer my account back to the council for them to take the following action a) Charge on my house - I currently live in a hostel. b) Bankruptcy - yipee! c) Imprisonment - I though a bit drastic.
They wrote back saying that they will not make me br but would consider applying to the courts for an order to commit me to prison.... But to continue paying any agreement I have at this time to stop any further action.

hmmm, I recently read of a case (forgive me i dont know if it was on here or news site) of a council who made a bloke BR for 1200 worth of council tax. The bloke managed to overturn the BR and the council involved had to pay all costs assosiated with the BR a staggering £38k, however the chap involved still had to pay the £1200 :-)0
