HSBC demand - should i pay the charges?

Hi
I used to have a HSBC current account. I changed banks, they cancelled my overdraft and now i owe them £739.
I have agreed to pay £414 in two installments but the other £325 is charges they applied to my account.
I already have a court case to reclaim previous charges currently on hold (my court date was 2 days after they agreed to hold all cases). Including interest up to Aug 2007 the amount i am reclaiming is £1700.
Should i agree to repay the £325 owing on the bank account or should i tell them i wont agree to pay charges until the outcome of the case? Do i have any right to withold the money?

if you dont pay them, then they will continue to slap charges on your accont, plus debit interest.
best advice - pay it, then the moment the balance has cleared, speak to an advisor at HSBC telephone banking and register a legal challenge. You can do it on closed accounts. I just did it with HSBC as a matter of fact0
