Rent arrears eviction notice????

I've been living in a housing association property for 20 years,.I am a secure tennent
and have been recieving housing benefit recently. I was unaware of rent arrers of about £1000 due to housing benefit not being received, the council have stated that they sent a letter about this (which i never received) to me and now has reached the stage where its been to court. I dont think I have been served a proper notice yet? this has never happened to me before so I dont know, A family member has offered to pay the rent arrears for me and also wants to persue eirther an exchange or even to move in. Does anyone know if this is possible once an eviction notice has been served? Any advice would be greatly appreciated many thanks:confused:

Speak to CAB or shelter (on phone - see their site for number) for help...

This is two seperate things. As a secure tenant there a few ways for the tenant can be evicted, and rent arrears are one of them. If you have not received letters from the housing asso, go and ask for copies. Also go to the the housing benefit office and make sure that they have paid the correct amount of benefit.
The other is somebody moving in with you, this will mean that you will have to pay council tax for the full amount and you will not receive HB. Is the family friend trying to get on your tenancy?
Be-littling somebody only make's you look a bully.
Any comments I make on here are my opinions, having worked in the lettings industry, and through life.

You would have to have missed *several* letters before things had "gone to court" - and you would have been sent notice of the court date in advance too.

Is the HB paid direct to the HA or to you?

Did you attend court yourself and have you followed up the problems with the HB office?

Was a Possession Order or a Suspended Possession Order granted ? If so, have long have you been given?

As a secure tenant you would normally be able to exchange, but with another secure tenant. You need to sort out your arrears problem first: bear in mind that you may be classed as making yourself "intentionally homeless" if you lose your home because of persistent rent arrears.
