Got a ticket Parking Ticket-worth an appeal?(with pic)

Got a ticket Parking Ticket from a coin meter......

So I drive my car in an empty space along a road of what I thought to be 5 bays with parking meters.

So I look out of my car window to see what meter is assigned to my bay –
I turn my head to the right and count the number of cars to the number of parking meters post allocated. So I’m the fourth car down so I chose the 4th meter/post to put my money in.
Now I had a dentist appointment of around 30mins so I thought I’d pay well over and put in 1Hour 30mins in (as you know how long you can be waiting in dentists!)
So on my return only 20 mins later I find a parking ticket on my car stating

“Parked in a meter bay when penalty time is indicated”

So I’m now furious as there is still 1Hr 10 mins showing on the meter. But on a closer inspection of the meters there was a Double meter on 1 post right at the very end!!! It was well out of sight and you would only know that it was a double meter if you walked 3 cars down and inspected it due to the angle and position that the meters were situated on this post. Now I put my money in the closest meter to my bay, which you would expect to be the correct one.
I even double checked the “bays to meters” in front of my car but there was a van parked up on the curb unloading so I assumed that he could not be in a bay otherwise why is he on the curb – but I now know he was in the last bay covering the hashed lines.

Basically – I put my money in the wrong meter…….

So the attendant was right to give me a ticket as I was parked in a bay with a meter that showed Penalty.

But what is annoying me is that:

A) I put my money in what I thought to be my allocated Meter as it was the closest to my bay.
B) Nowhere does it state that there may be 2 meters on 1 post
C) I bet the Van that was parked on the curb obstructing my view of the bay didn’t get a ticket.
D) I purposely put more money in to cover any delays

It is almost like they have put the 2 meters on one post to catch people out (they succeeded with me!)

Now do you think is it worth me appealing my fine (explaining my situation a bit better that the above!)

Or

Do I put it down as me just not looking hard enough when parking my car!!!

Anyone else been in this situation ?

Thanks

The above detailed PCN was issued by Bexly Council.

Posted a copy of PCN below as link above appears to be a sticky. So will probably get told to remove.

  • Bexley along with other local authorities are blatantly profiteering, anyone with any sense can see you intended to pay your dues it is totally pathetic that you have actually got a valid ticket but from the wrong machine!

how the hell can it be from the wrong machine! its on the same side of the road, same street, same council, same money, same stupid beaurecratic bull*** i say

I had a parking ticket claim going on with Bexley....

(or Sureway as they cal themselves to distance from the fact they are the local authority)

.... for can you believe 5 years..........GASP! YES 5 YEARS! so far!

each time i proved the ticket was nothing to do with me (I Had sold the car and done everything possible to notify DVLA i no longer owned the vehicle) i proved this time and time again but they still insisted on going away temporarily only to resurface again after a few months for the same PCN!

Even had the bailiffs on my doorstep demanding £490.00 until i showed them the letter i had proving i wasnt the owner on the date of the alledged offence. The bailiff shrugged his shoulders and said "Oh well Bexley are one of the worst for PCN,s (along with Camden i believe) he turn tail and walked back down my path never to be seen again!

Even after that i recieved a court summons to appear before magistrates which i duly did after taking a day off from work (unpaid) and hey ho guess what Bexley didnt even SHOW UP!!! hence judge threw their case out deeming me "innocent" :rotfl:

that court appearance was 2 years ago so am still holding my breath i just sooo know they will come again!!

I would appeal if i were you even though technically according to Bexley obvious unlogical regulations you are guilty but im sure if you take it to court stage a judge will see you are not a criminal but a decent person trying to get on with their day to day life! i would go down that avenue (scuse the pun) even if just out of principle they are blatant robbing Bleeeeeepps!!

for more advice try https://www.pepipoo.com (very helpful independant website regarding PCN,s, traffic offences etc) or/and speak to PATAS (Parking and Traffic Appeals Service)

    Anyway....

I wish you luck you are gonna need it i can tell you if you are flush just pay its a whole lot easier :rotfl: 5 YEARS of grief i had from then so far!!!! so maybe £60.00 isnt such a bad price and the worst thing is they know this ....GGGGGRRRRRRRR!!!!!! Soapbox or what!!! :rotfl:

5 Years that's incredible!!! - Fingers crossed you've seen the back of them.

Thanks for your reply and advice links I will be taking a look at them later. I will be posting my 2 page letter and 3 additional pages of evidence tomorrow. (That took 2 hours to compile!!!)

But as you say may be quicker and less stressful just to pay them money (don't see why I should though)

I'll see what sort of response I get first.

    Thanks again.
  • i totally back you all the way why should u pay? you shouldnt!!!!!!!! but alas the red tape i have recieved over the 5 years mine was farcically going back and forth the initial £60 didnt seem a bad price to pay with hindsight thats all i was saying

firstly put in your appeal and wait for the ...... sorry but

sift through the websites i suggested https://www.pepipoo.com in particular have some very good forums there and many people will advise you properly of how to go about dealing with joker councils!

    good luck! ;)
