Overpaid, now have to pay it back

My OH's company has just realised they overpaid him, we ourselves hadn't noticed. Basically what happened was the company paid the recruitment agency out and put my OH on a temp contract direct with the company.

This was back in Aug. Now he's had a letter to say that they overpaid him £200 when everything switched over to them from the recruitment agency.

They claim they need it back by the end of the tax year, so they've drawn up a letter for him to sign agreeing to pay back £25 every week.

Can they do this, i mean demand that much back every week? £25 a week is a lot, do they really need it all back by the end of the tax year or are they just saying that??

Obviously it has to be paid back, im not disputing that, its just the amount im not keen on. I thought they would of said like £30 a mth or something to that figure.

    Did they explain exactly where this £200 was overpaid. If not i would want a few more details and not just take their word for it.

    if indeed you do owe it tell your husband to negotiate with them for a more realistic figure.
    If you can afford £25 a week its worth going for as the debt will be clear in eight weeks and not 7 months or so.
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    I think they are being quite fair is agreeing to £25 per week. Put boot on other foot, if they owed you £200 would you agree to them paying back £25pw... of course not, you would want it now

    How much extra per week was your OH getting?

    By law they dont actually have to consult you, all though it is agood practice to arrange a repayment amount etc. But if they wanted they could take the lot in one go!

    Write back and say you are unable to afford this and suggest £50 a month, thats the only thing you really can do.
  • We didn't notice the extra payment cos he does quiet a lot of overtime. That week he bought home £306, we didn't think anything to it. (by the way it wasn't extra per week for a # of week he was overpaid, they claim it was £200 in 1 weeks wages)

    As for example this week he's just bought home £343 as a result of a 61 week and yesterday he worked 17 hours.

    Only this year as 2009, not tax year have they started to put at the top of your pay slips the hours you did each day for that week, so we always check if its correct as OH put on the calendar how many hr's for each day he worked. When he was working through the recruitment agency they never put your hours on the pay slip.

    Also as a result of his long day yesterday changed it today that every driver cannot do over 13 hours a day.

    Another question i need some advice on though.

    Can they ask you to stay out for a night, have you foot the bill and then give it back in wages???

    He's just rang and is in Dorset on Monday, but is staying over. We have to foot the bill...

    Where not exactly rolling in money. They didn't do this last time he stayed away, last time he was away for 4 nights and they paid everything in advance.

    I know its only 1 night, but we don't exactly allocate money for 'maybe' hotel stays. Especially as though he won't get it back till Friday, wouldn't be so bad if they had like a 'kitty' and gave it him back in cash on Tuesday when he returned to the yard.

    That is standard practice. Many who do it regularly will have a separate credit card to cover expenses, either arranged personally or through the company. If you cannot afford it, you will need to ask if they can pay in advance, however this may not go down too well when you owe them money!

    you need to start a new thread of your own and give more details.
    what number, what book, etc
    make the most of it, we are only here for the weekend.

    Hi Sigrid,

    Call Job Centre Plus 0800 055 6688 (8am - 6pm Monday to Friday). It's a freephone number (unless using mobile) & you can claim on line. Suggest you do it asap! Good luck
  • But see the company actually do do it quiet regular.

    I can never understand the practice of making the employers pay for everything and then claim it back. They only paid in advance for his 4 nights away cos 6 men stayed out to do a job in London and they all said they weren't doing it unless the company paid in advance.

    I don't know the full story yet as OH isn't home. I did ask him why they weren't paying like last time and he just said they're not, so maybe couldn't say much over the phone. As he's on a temp contract and was outta work last year for 6mths i don't blame him for not pushing the issue too much.

    I just think its a bit rude to send employers away to do a job but make them cover the cost and then wait till pay day to get it back.

    It's extremely rare for companies to give out cash in advance for expenses such as this.. in fact, I've never come across it before except in the forces.

    Maybe he could ask his boss/manager to book it for him if they have a company credit card?
