    The ring is a contract to marriage... If marraige doesn't occur then she should actually return the ring...

    I saw a case on judge Judy once... But not sure if it would work in the UK courts system...

    Krystal..i saw that on Judge Judy too:D , and the guy got the ring back! But as you say, i dont know either if its the same case legally in the U.K.:confused:

    Erm, yes it does. Its part of a contract and she broke it. Therefore it has to be returned or he can take her to court.

If the woman breaks the engagement then the man is legally entitled to the return of the ring. However if the ring was offered as part of a gift, for example on Christmas day or Valentines day then it will be seen as a gift and does not need to be returned. Each case is different and it will usually be left to the couple to decide who keeps the engagement ring. The engagement ring is usually seen as an unconditional gift in the UK."

    As far as I can remember this is the situation:

    The ring is only legally returnable if it was a conditional gift but there is a legal presumption that engagement rings are unconditional gifts. So, normally there is no obligation to return them.

    However if, when the ring was given, there was an arrangement/agreement that it be returned if they didn't get married then there is an obligation to return it.

    I think your nephew should just walk away from this. £1000 may seem like a lot of money but it may have been worth it to get shot of her :)
