Overdraft Loan Guard, Can I Claim ??

I have just noticed a £3 charge on my account going back the last 6 years. Looking further into it it appears to be an Overdraft Loan Guard charge on my RBS account.
To be honest I dont even remember being told about this at the time and just took it as a charge for having the overdraft.
Does anyone know if this charge can be claimed back? there does not seem to be a great deal on information available on this matter

I have been with HSBC for approx 20 years and have an authorised overdraft of 1000.00, but recently I went over my overdraft without realising, (they carried on letting me use my switch card!) once I realised my error I put money straight back into my account, but unfortunatly in HSBC eyes it was too late and they are charging me £25.00 4 everytime a transaction went over in total there were 5 transactions so r chargin me 125.00. I only work part time and this is a massive part of my wage so is going to cripple me and my family this month, they havent taken it out of my account yet so does anyone know what my rights r here before they take it out.
