Section 75 Fraudlent Credit Transactions

I've just recievd my credit card from MBNA for £19.19 (which I was surprised about as I hadn't used it for months) Their a transcation for some kind of subscription although it not something I 've subscribed to. I told the lady it wasn't something I had authorised. She said thier nothing MBNA could do as it was a subscription and was below £100.

She did give the number of the retailer, although it just goes to a voicemail.

Are MBNA Correct in advising this? Secondily how do I prevent this retailer taking further payments?

    Section 75 isn't appropriate in this case, as you are claiming its a fraudulent transaction (and its also under £100).

    If you are sure that the transaction is not yours you will need to dispute it with MBNA, however MBNA are correct in saying that they cannot stop them from taking future payments, as (correctly or incorrectly) it appears that a Continuous Payment Authority has been set on your account which must be cancelled by the retailer.

    Thanks for that, in view of the sums involved I think its prudent just to pay the 19.19 aned cancel the card. MBNA don't appear to very customer focussed

    You need to contact the company involved. I've read stories on here of customers who have cancelled cards & have then had a continuous payment authority appear on their account a year later.
  • If you are sure that the payment is unauthorised then you must report it as fraudulent to MNBA. There is an Eastern European gang who specialize in hitting CC cards with small charges. Because the charges are so low ( generally in the £5-10 range) many people miss them when their credit card statement comes in.

    If the person complains direct to the company making the charge then their account is credited ( to ensure that the charge-back ratio does not exceed a certain level and lead to a closer examination of the company etc) Filing a fraud report with your CC issuer is the only way to proceed where your card has been hit fraudulently.

    That is normally the case, however if the bank is satisfied that it is fraudulent they can stop it themselves.
